WebCapades — Terms of Service
These Terms of Service ("Terms") govern your use of this website and services provided by Kristine Mitchell Consulting LLC ("WebCapades," "I," "me," "my"). By using this website or engaging services, you agree to these Terms.
1) Services
WebCapades provides Amazon marketplace consulting and account management services, which may include advertising management, listing optimization, creative direction, operational guidance, and performance analysis.
2) Independent service provider (no Amazon affiliation)
WebCapades is an independent service provider and is not endorsed by or affiliated with Amazon.
3) Website use
You agree not to misuse this website, attempt unauthorized access, or interfere with site functionality.
4) Scope of work
Services are delivered based on a mutually agreed scope (proposal, email confirmation, or contract). Scope, deliverables, timelines, and fees vary by engagement.
5) Client responsibilities
To work effectively together, you agree to:
- Provide accurate information and timely responses
- Maintain responsibility and ownership of your Amazon selling account
- Authorize access through Amazon's current access/permissions workflows (as applicable)
- Review and approve major decisions that could impact brand, compliance, or budget
6) No guarantees
Amazon marketplace outcomes can be influenced by factors outside my control (competition, inventory constraints, policy changes, algorithm shifts, platform outages). I do not guarantee specific results (sales, rank, ACoS, TACoS, etc.).
7) Fees and payment
Fees are shown on my Pricing page and/or in a written scope/quote. Unless otherwise agreed in writing:
- Retainers are billed in advance for each service period
- One-time projects may require an upfront deposit before work begins
8) Confidentiality
Both parties agree to treat non-public business information shared during an engagement as confidential and to use it only for the engagement.
9) Intellectual property
Unless otherwise agreed in writing:
- You retain ownership of your brand assets and account data
- I retain ownership of my frameworks, templates, processes, and know-how
- Deliverables created for you may be used by you for your internal business purposes
10) Termination
Either party may end an engagement as described in the written scope/contract. Any outstanding balances remain payable. Data handling and deletion follow the Privacy Policy.
11) Limitation of liability
To the fullest extent permitted by law, WebCapades will not be liable for indirect, incidental, special, consequential, or punitive damages. Total liability for any claim related to services will not exceed the amount paid to WebCapades for the services giving rise to the claim during the applicable service period.
12) Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles.
